10. मुकदमे में बिहार सरकार का झूठ

धनबाद में पुलिस और कैदियों के साथ हुई मेरी झड़प और मेरी मार-पिटाई को लेकर दायर मेरे इस मुकदमे में प्रेस परिषद ने बिहार सरकार से भी जवाब मांगा था। प्रेस परिषद को भेजा गया बिहार सरकार का जवाब पूरी तरह मनगढंत, झूठ और एक फेस सेविंग था। सरकार के सचिव ने अपने जवाब में धनबाद जिला प्रशासन और पुलिस का ही पक्ष लिया और पुलिस के साथ हुई झड़प की घटना में मेरे आरोपों को सिरे से नकारते हुए पग-पग पर मेरी ही गलती बता दी। बिहार सरकार की चिट्ठी का मजबून कुछ इस तरह था-

Sub:- Complaint of Dr, G.P. Jha, Journalist, against the Dhanbad Police.

Sir,

With reference to your letter no.13/31/84- Sectt. Dated 15-12-84 on the above subject, I am directed to say that the allegations made in the complaint petition dated 3/9/84 of Dr G.P. Jha, Journalist have been looked into and facts are as below:-

(i)       Dr G.P. Jha has alleged that on 1.2.84 while he was taking photographs of the objectionable activities of the under trial prisoners in Dhanbad Court, on instigation of the police, the prisoners caught hold of him, severely assaulted him and badly damaged the camera which was later snatched away by the police.

It appears from the enquiry that when some prisoners were being taken from jail to Dhanbad Court on 1.2.84, they noticed a man taking their photographs. They objected to it on the ground that the photographs might be used against them during T.I. Parade. The prisoners made known their objections to the escorting police. The man with the camera was brought to the police station by the Havildar. According to the statement of these prisoners, there was only some hot exchanges of words with the man taking the photographs, and no incident “marpit” took place. The above statement of the prisoners was also supported by Havildar Suraj Singh and the Constable who were with the police party on that day. The Station Dairy Entry in Dhanbad Police Station on 1.2.84 also indicates that the person concerned was brought to the police station where the reel from the camera was taken out and deposited in the Malkhana.

 

(ii)      Dr. G.P.Jha has further alleged that he went to S.P. Dhanbad with a petition containing facts about the incident but the S.P. misbehaved with him and refused to acknowledge receipt of the petition.

It appears from the enquiry report that the above allegation against the S.P. is baseless. As can be easily appreciated, the S.P. is not supposed to personally grant a receipt for applications received. If any receipt is sought for, it has to be obtained from the office.

 

(iii)     Dr. G.P. Jha has also alleged that he went to the Deputy Commissioner, Dhanbad and submitted a written petition about the above incident.

The Deputy Commissioner, Dhanbad has reported that Dr.G.P.Jha had given him a written petition on 6.2.84 containing some allegations against Dhanbad police and on receipt of the petition, he got the matter inquired into through the S.P., Dhanbad. The allegations were, however not substantiated.

 

(iv)     Dr. G.P.Jha has, in his complaint petition to the Press Council of India, made certain allegations against the management of “Janmat”. The state Government are not concerned with these allegations against the proprietor and management of “Janmat”.

2. I am to request that the Press Council of India may kindly reject the complaint petition of Dr. G.P.Jha, Journalist, in the light of the facts stated above.

3, This also disposes of the Press Council of India’s letter of even number, dated 27/4/85. The letter of Dr..Jha, dated 15/3/85, enclosed with the above letter of the Press Council of India, contains the above points which are there in his complaint petition, dated 3/9/84, and which have been dealt with above.
